Definition
Eminent domain is the government's right to take private property for public use, even if the owner doesn't want to sell it. The Fifth Amendment of the US Constitution allows it, but requires "just compensation" be paid to the owner. Think of it as the government having a special need that outweighs individual property rights. It's often used for building roads, schools, or other public projects. This power is not unlimited, and is subject to legal challenges to ensure itβs genuinely for public benefit and fairly compensated.
