"Permissive waste" is an older term referring to neglect or minor damage to a property by a tenant that is allowable under the terms of a lease or agreement. It is contrasted with voluntary waste, which is intentional damage. It typically involves normal wear and tear, such as faded paint or worn carpets. Unlike deliberate destruction, permissive waste results from a failure to maintain the property adequately. Landlords often anticipate and allow for a certain degree of permissive waste. This needs to be distinguished from intentional damage. Think of it as accepting small amounts of wear-and-tear over time.
